Important Beta Notice:

FluenceX is currently operating in its beta phase. This means our platform is under active development, and certain features and functionalities are still being refined and implemented. During this beta period, you acknowledge and understand that:

Platform features and services are actively under development and will be progressively deployed
Access to the platform is managed through a waiting list system
These Terms of Service may be updated as the platform evolves
Your feedback and participation help us improve our services for the official launch

By accessing or using our platform, you ("User," "you," "your") agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please refrain from using our platform.

2. Eligibility

To participate in the FluenceX platform, you must meet specific eligibility requirements. Users must be at least 18 years old or of legal age in their jurisdiction to participate. By registering on FluenceX, you explicitly represent and warrant that you meet all eligibility requirements.

3. Account Registration and Use

Account Creation: During our beta phase, account creation is managed through a waiting list system. When selected from the waiting list, you must provide accurate, complete, and up-to-date information to create your account. Selection from the waiting list is at our discretion and may depend on various factors including market needs and platform capacity.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We implement strong security measures, but the effectiveness of these measures depends on your cooperation in keeping your account information secure and confidential.

4. Beta Services

FluenceX facilitates connections between Creators and Brands for social media promotion campaigns. During our beta phase, we are progressively implementing and testing various features. Our current and planned services include:

Basic Features: Platform access, profile creation, and basic interaction capabilities
Upcoming Features: Campaign matching, secure payment processing in EUR and/or USD, escrow services, and advanced analytics

We do not guarantee any specific engagement or results for campaigns, nor are we responsible for any aspect of the interaction or collaboration between Creators and Brands.

5. Intellectual Property

Platform Content: All materials, including but not limited to software, text, images, graphics, overall design, and trademarks displayed on the FluenceX platform are owned by or licensed to FluenceX. Users receive a limited license to access and use this content solely for platform-related purposes.
Campaign Content: Content created by Creators during campaigns remains their intellectual property unless otherwise agreed upon in a separate campaign agreement. By participating in a campaign, Creators grant Brands a limited, non-exclusive, royalty-free license to use Campaign Content for campaign purposes only.
User Content: Content submitted by Users, including profiles and social media information, remains their property. Users grant FluenceX a limited license to use, display, and distribute this content for platform operations.

6. Prohibited Conduct

To maintain platform integrity, users are strictly prohibited from engaging in the following activities:

Using the platform for any illegal or fraudulent purposes
Attempting to bypass the waiting list or account creation process
Creating multiple accounts or misrepresenting identity
Using automated systems or bots to access the platform
Interfering with platform security or functionality
Engaging in any activity that could harm other users or the platform

7. Future Payment Terms

While payment features are still under development, we want to be transparent about our future payment framework:

Currencies: The platform will process payments in EUR and/or USD, with specific currency options determined based on user location and preferences.
Payment Processing: Transactions will be handled through secure third-party payment processors, with an escrow system to be implemented for additional security.
Service Fees: Our fee structure will be clearly communicated before the launch of paid services. No fees will be charged during the beta phase.

FluenceX will not disclose User's confidential information to third parties without consent, except as necessary to provide platform services or as required by law.

11. Disclaimers

During this beta phase and beyond, FluenceX provides the platform "as is" and without warranties of any kind:

No guarantee of continuous or error-free operation
No warranty regarding platform reliability or availability
No representation about the accuracy of beta features
No guarantee about the final form of features or services

12. Limitation of Liability

To the fullest extent permitted by law, FluenceX, its affiliates, and its agents are not liable for:

Any direct, indirect, incidental, or consequential damages
Loss of data, profits, or business opportunities
Any issues arising from beta testing participation
Technical problems or service interruptions

In no event will FluenceX's liability exceed the amount paid by you, if any, for accessing the platform.

13. Termination

FluenceX reserves the right to terminate or suspend access to the platform:
